Division of Marital Property

Under Wisconsin laws, marital property is to be divided equitably (fairly).  This does not necessarily mean that property division will be an equal 50-50 split.  To ensure a fair distribution, we make sure that all assets and debts are identified, properly valued and considered in property division and debt allocation.  Marital property may include real estate, retirement funds (401k, pension, IRAs, etc.), savings or checking accounts, vehicles, stocks and bonds, business interests and all other assets.  When necessary, we hire investigative accountants to identify marital property which may be hidden by one spouse.  

Neither party is automatically entitled to spousal support (also called spousal maintenance or alimony).  Rather, the court considers many factors to determine if spousal support should be awarded.  Some factors considered include the length of the marriage, income levels of each party and the need for rehabilitation into the workforce.
